Update, April 7, 2023: Since publication, Judge Clarence Thomas has issued a public statement defending his secret trip. In late June 2019, after the US Supreme Court issued its final ruling on this term, Justice Clarence Thomas boarded a large private jet bound for Indonesia.
He and his wife were on vacation: a nine-day trip to a volcanic archipelago on a superyacht piloted by a private chef. If Thomas had chartered the plane and 162-foot yacht himself, the total cost of the trip would have exceeded $500,000. Fortunately for her, she didn't have to: She vacationed on a jet and yacht with real estate mogul and Republican megadonor Harlan Crowe.
For more than two decades, documents and interviews show that Thomas literally received annual luxury trips from Dallas business owners. A civil servant with a salary of 285 thousand US dollars is vacationing around the world on Crow's superyacht. He flies Crowe's Bombardier Global 5000.

These trips were nowhere to be found in Thomas's financial records. His failure to report the flight appeared to violate post-Watergate laws that require judges, magistrates, members of Congress and federal officials to disclose most gifts, two ethics law experts said. He also should have disclosed that he had been on a yacht, these experts said.

In a statement, Crowe acknowledged that he had provided Thomas with "hospitality" over the years, but said that Thomas never asked for it and that it was "no different than the hospitality we have extended to many of our other dear friends."

By accepting the trip, Thomas violated long-standing rules of judicial conduct, ethics experts and four current and retired federal judges said. "It's beyond me that anybody would do that," said Nancy Gaertner, a federal judge appointed by President Bill Clinton.
While on the bench, Gertner was so careful about his appearance that he didn't mention his title when ordering dinner: "It was about not wanting the office to be used for anything other than what it was intended for," says Gertner. Virginia Kanter Thomas, a former government ethics lawyer who served under both administrations, said Thomas "seemed to have a complete disregard for his high moral obligations."

ProPublica drew on Thomas' flight logs, internal documents distributed to Crowe employees, and interviews with dozens of people from his superyacht crew to members of the secretive Bohemian Club to a diving instructor in Indonesia to uncover the details of his journey. Federal judges hold special positions of public trust.

They hold office for life, which is intended to insulate them from political pressure and potential corruption. The code of conduct for lower federal judges of the Supreme Court requires them to avoid even "improper appearance." Supreme Court members, Chief Justice John Roberts wrote, "consult" the code for guidance.
The Supreme Court remained almost entirely policed. There are a few restrictions on the gifts judges can accept. It is different from other branches of government. Members of Congress are generally prohibited from receiving gifts of $50 or more, and many trips received from Thomas Crow require prior ethics committee approval.
Thomas' approach to ethics has already attracted public attention. Last year, Thomas pleaded not guilty to charges related to his wife Jeanie's attempt to nullify the 2020 presidential election. Crowe met Thomas after his justice. People who know the two men say that the couple have become close friends.

Over the years, some details have emerged about Crowe's relationship with the Thomases. In 2011, The New York Times reported on Crowe's generosity to justice. That year, Politico revealed that Crowe gave half a million dollars to a Tea Party group founded by Ginny Thomas and paid her $120,000.

Crowe said in a statement that he and his wife never discussed the pending or lower court case with Thomas. "We have never tried to influence Judge Thomas on any legal or political issue," he added. In his public appearances over the years, Thomas has shown himself to be an ordinary man with modest tastes.
