All of this is explained in HUD Handbook 4000.1, Single Family Housing Policy Handbook. With that simple answer, let's take a deeper look at the FHA down payment gift rules and procedures. According to the Department of Housing and Urban Development, which administers the FHA loan program, borrowers must have a minimum down payment of 3.5% when using the program.
Specifically, it is 3.5% of the home's purchase price or the appraised value, whichever is lower. This relatively low payout is part of what attracts people to the program in the first place. The good news is that this initial investment does not come out of the home buyer's pocket.
An FHA payment can be made as a gift from a family member or other approved donor as defined by HUD guidelines and requirements for 2017. That's why this program is so popular among middle- and low-income borrowers (although it's not limited to this group).
Can My Fha Down Payment Be Gifted?
In the FHA policy handbook, HUD defines a gift as "a contribution of cash or equity without expectation of repayment." These last four words are important. If a family member, employer or other approved donor financed your mortgage payment, you should not expect to be reimbursed.

In other words, gifted funds should actually be a gift, not a loan. You can give yourself a gift, but you can't take it from someone else. According to HUD Handbook 4000.1, an FHA down payment gift may be provided by: It is our understanding that the seller may pay for the buyer's closing costs, but not the down payment.
HUD considers sellers, real estate agents, builders, and developers to be "parties interested in the transaction." And these interested parties cannot pay for the borrower's minimum required investment or MRI. This is in accordance with HUD Handbook 4000.1 (page 232). At a minimum, the letter should state that the donor does not expect any payment as mentioned above. The nature of the relationship should also be disclosed. If you had some or all of the payment made to you by a third party, the mortgage lender must properly document the payment before closing.
It also has special requirements as described below. In such cases, the lender must confirm that the agent has received the gift funds from the donor.

As explained above, mortgage lenders must also ensure that the funds are donated from an acceptable source. If documentation from a bank or other savings account is not available, "the payee must provide written evidence that the funds were received from an acceptable source, not a party to the transaction."

While the FHA has restrictions on how gift funds can be used and who can and cannot give the funds, to use FHA gift funds, you will need a letter from the donor stating that the money is a gift and not a loan.
